Fee arrangements for immigration services

As a very individual law firm, Azarmi Law has very individual clients with very individual needs; so no surprise then that our services are not “pre-packed” or “one size fits all”. Individuality, however, is not an excuse for avoiding clarity and transparency about how we charge for our services and how you, our client, can expect a quality service at competitive prices.

Every client is different and will want us to recognise the huge variations in pressures, priorities and preferences when it comes to working with them.

The first step in any fee arrangement is to ensure that we understand the case and all its relevant issues, complexities, timeframes and constraints.  Once we have this understanding of the technical requirements, it is also about understanding the clients and what fee arrangements will make him/her feel most in control, but at the same time, sufficiently looked after.  Everyone is different. We will define the costs and disbursements for your case at the outset of each matter in our client care letter.

Fixed & capped fee quotations

Where it is feasible, and the terms of reference based on the “scope of work” is unlikely to change, we will offer fixed fees.  This is a fixed quote which will be charged on completion of the case providing the initial terms of reference have not changed.

We are also happy to discuss “capped” fees; this is where it is not so easy to confirm the terms of reference but is a means by which the client is assured that the fee won’t be more than a certain figure, the “capped” fee, but that in the event that it takes us less time to achieve the results required, the client will be charged at the lower fee, equating to time spent rather than the higher “capped” rate.

How our fixed & capped fees are calculated

The basis of all our quotes is the charge out rate per hour for each member of the team which is based on their individual expertise, experience and aptitude.  As you would expect our founding partner Sally Azarmi will command the highest hourly rate between £350 – £450; our Paralegals Jayne Wade & Mitchell Potter have the lowest at £150.  However, Jayne is the most experienced member of the support team in terms of managing the huge administrative process of visa applications and so the best woman for the job both in terms of value and skill levels.  We are committed to use the strengths of our team members to best effect and to end benefit of our clients and so as well as individual hourly rates for our lawyers, we may refer to “blended rates” to reflect a composite team hourly charge.

Scope of work & timelines

We provide an attentive and bespoke service throughout each application we deal with.  The work that we undertake for each application for which the fees are quoted will include the following:

  1. Meeting with you in person or virtually to take initial instructions and advising on the best way forward.
  2. Advising you in detail on the evidential and procedural requirements of your application.
  3. Reviewing your evidence in detail.
  4. Completing and submitting the application form.
  5. Drafting any supporting documentation needed for the application.
  6. Providing a legal covering letter making any factual and legal representations necessary for the application.
  7. Booking your Biometrics appointment.
  8. Where applicable creating the ‘Electronic bundle’ and creating a hard copy bundle.
  9. Informing you of the outcome of your application and advising on any ancillary questions.

The different stages of most applications are as set out as above. However each case is different and there may be other steps involved on which we would advise on at the outset of your case.  The Timeline for our taking your instructions to submission of your application will vary according to how quickly you are able to provide the necessary evidence and when you wish to enter the UK or expiry of current Visa.

Please note: The Home Office processing times are not in our hands and can vary depending on the service you opt for through the Home office. Applications may be processed from between 24 hours to 6 months or more. We will provide you with our best estimate based on the facts of your case.

As a specialist legal provider we are now required to publish our average fee ranges as well as the applicable disbursements (including Home Office fees and other charges payable to third parties). However as a firm we offer bespoke quotes and as each case is unique and your individual application may result in lower or higher fees than those listed below.

Innovator & start up visas

In March 2019 the Home Office announced two new visa routes to replace the current Entrepreneur routes, the Innovator and Start-up visa’s.

An Innovator visa allows an individual to come to the UK to set up or run a business if it has been endorsed by an approved body. Individuals must invest £50,000 into their business in order to qualify for the Innovator visa.

A Start-up visa allows individuals to come to the UK to set up a business, this business must be endorsed by a UK higher education institution or by a business organisation with a history of supporting UK entrepreneurs.

We are able to assist in all elements of starting a business in the UK, including drafting business plans and putting you into contact with accountants to help with registering your company for tax and VAT.

Fees:

As these are new visa routes we cannot say with certainty how much each application will cost, however we estimate that our fees will be in the range of £10,000 to £20,000 + VAT and disbursements for Innovator applications and £3,000 – £8,000 +VAT and disbursements for Start-up applications.

Skilled Worker visa

A Skilled Worker – General visa allows skilled workers to enter the UK to work for a maximum of 6 years. This route leads to settlement after 5 years.

Fees:

Skilled Worker (intra-company transfer) visa

Skilled Worker visa – ICT, allows the transfer of employees from the offices of international companies to the UK.

Fees:

Skilled Worker (Sportsperson) visa

Skilled Worker visa – Sportsperson is for elite sportsperson or qualified coach, who’s recognised by the relevant sports governing body as being at the highest level of your profession internationally.

Skilled Worker - Minister of Religion visa

Skilled Worker visa – Minister of Religion is for applicants that have been offered a job within a faith community (for example as a minister of religion, missionary or member of a religious order) in the UK.

Tier 4 (general) visa

Tier 4 general visas are for those applicants that are 16 and over and have been offered a place on a educational course in the UK.

Fees:

Tier 4 (child) visa

Tier 4 – Child are for those applicants aged  between 4 and 17 and want to study at an independent school in the UK.

Tier 5 (temporary worker) visa

Tier 5 Temporary worker allows applicants to come to the UK to live and work for up to a maximum of 24 months depending on the type of visa you are applying for.

Tier 5 Youth Mobility allows applicants aged 18 to 30 to live and work in the UK for up to 2 years if applicants are from the following countries:

  • Australia
  • Canada
  • Japan
  • Monaco
  • New Zealand
  • Hong Kong
  • Republic of Korea
  • Taiwan

Fiancé & marriage applications

Fiancé & Marriage Applications fall into three different visa types. It is also possible to switch into a marriage visa if you are currently in the UK and married to a settled person.

Fiancé Visitor Visa – This Visa allows migrants to come to the UK for a maximum of 6 months to marry. Once the marriage has been completed migrants must leave the UK and reapply to enter on a marriage or partner visa.

Fiancé Settlement Visa – This Visa allows applicants to come to the UK for a maximum of 6 months in order to marry. However once the marriage has been completed you are entitled to switch this visa type into marriage or partner visa from within the UK

Spouse or Partner Visa (marriage) – This Visa allows spouses to come to the UK to join their settled partner.  After 5 years of continuous and lawful residence you may be eligible to apply for Indefinite leave to remain (settlement).

Other family member applications

Applicants require a family visa if they intend to live with a family member in the UK for more than 6 months. You can come to the UK to live with your child, parent or a relative who will provide long term care for you.

After 5 years of continuous and lawful residence you may be eligible for indefinite leave to remain.

Representative of an overseas business visa

Representative of an overseas business visa allows a sole representative of an overseas company wishing to set up a UK branch or a wholly owned subsidiary or an employee of an overseas newspaper, news agency or broadcasting organisation posted on a long term assignment to the UK to enter the UK to live and work. After 5 years of continuous and lawful residence applicants may be eligible to apply for Indefinite leave to remain (settlement).

EU Citizens & their family members

EU Citizens and their family members can apply to come the UK to live and work as long as they are exercising one of their treaty rights. After 5 years of being resident in the UK EU Citizens can apply for a Permanent Residence card.

Please Note: From the 29th March 2019 the UK will leave the EU and EU citizens will have to apply for settled or pre-settled status under the new EU Settlement scheme.

Our fees under the new EU Settlement Scheme start from £750 plus VAT and disbursements.

No time limit applications

No Time Limit Applications are for applicants who have already obtained Indefinite Leave to Remain (settlement) in the form of a stamp in an old passport. The NTL Application transfers this stamp from the passport to a Biometrics Residence Card which then provides valid evidence of Indefinite leave to remain (settlement).

Indefinite leave to remain in the UK (settlement)

Indefinite Leave to Remain (settlement) allows applicants to permanently reside in the UK without the need for a Visa. Applicants can usually apply for ILR after 5, 10 or 20 years depending on their circumstances.

UK Ancestry visa

UK Ancestry visa allow commonwealth citizens, to enter the UK, who are able to prove that one of their grandparents was born in the UK and are able and planning to work in the UK upon their arrival. After 5 years of residing in the UK continuously and lawfully you may be eligible to apply for Indefinite leave to remain (settlement).

Fees:

From past experience our fees for a UK Ancestry application (main applicant) range between £2,500 and £5,000 plus VAT and disbursements.  Our fees will vary depending upon certain factors, such as the facts of each case, the complexity and urgency of the application and the stage of the application i.e. whether it is an initial or extension application or an application for settlement (indefinite leave to remain).

Disbursements:

The disbursements for this application usually include the following:

1. Application fee for UK Ancestry – these fees change from time to time. For current fees please click here.
2. Immigration Health Surcharge (if applicable).  This is currently £400 for each year of visa
3. Home Office premium service charges – these vary depending on the service used and whether the application is made in country or out of country – please click here to view current fees
4. Other disbursements which may vary for each individual application, such as TB test certificate; courier; language tests – all disbursements will be set out on being instructed on each individual application

Discretionary applications outside of the immigration rules

Discretionary applications allow applicants who do not meet the immigration rules to apply outside of the rules and ask for discretion to be applied to the application. These applications are often complex and evidence heavy.

Our fees for appeals, administrative & judicial reviews start from £2000 plus VAT and disbursements, however due to the complexity and unique facts of each case these prices can vary substantially.
